Model Railroad Design
Agreement
This Agreement is made between ________(Client) with a residence at
____________ and RailDreams, Inc.(Contractor), with a principal place of
business at: 310 Calumet, Lake Linden, MI 49945.
This agreement entered into on ___________________________.
Services to be Performed
Contractor agrees to develop a Model Railroad concept design(not for
building use) for preliminary approval of Client. If Client approves and
agrees to further work, Contractor will develop a CAD rendering on D or
E-size paper for Clients use in building a model railroad.
Payment
In consideration for the services to be performed by Contractor,
Client agrees to pay Contractor $45.00 per hour in accordance with the
terms set out below.
Terms of Payment
Contractor shall be paid $300.00 as a deposit before initial rendering
of model railroad layout begins. When initial sketch is shipped to
Client, the Client will be invoiced for total hours spent developing the
rendering. (Approximately 8 to 10 hours typically required.) If Client
approves sketch and wishes a CAD rendering to be developed, all prior
invoices for work done on initial concept rendering must be paid in full
before work on the CAD rendering can begin. Once a preliminary CAD
drawing has been developed, Client will receive an advance copy(typically
8"X10" size) for review and corrections. Client will also
receive an invoice for total hours work into CAD rendering. (Typically
20 to 40 hours depending on the complexity of the drawing.) Payment for
hours of work on CAD rendering to date is due at this time. Once Client
has approved preliminary CAD drawing and submitted payment for invoiced
hours, the final copy will be printed on D or E-size paper and mailed to
Client.
Client acknowledges model railroad layout may require adjustments
during construction not reflected on original design plan. These changes
are a normal part of the construction process and are not the
responsibility of the contractor.
If Client plans to construct the model railroad layout from the plans
developed by the Contractor, Client assumes responsibility for
interpretation and application of plans to construction. Contractor
assumes no responsibility for consulting during construction unless
Client agrees to purchase construction and/or consulting services from
Contractor. These services require a separate agreement and are not
covered under this agreement.
Terminating the Agreement
Either party may terminate this Agreement any time by giving
thirty days written notice to the other party of the intent to terminate.
Exclusive Agreement
This is the entire Agreement between Contractor and Client.
Applicable Law
This Agreement will be governed by the laws of the state of Michigan.
